Form 8843
Most international students, scholars, and dependents who are a nonresident alien for tax purposes must file form 8843, even if you did not have any source of income for the current or previous year. Form 8843 is required to explain your claim that you can exclude days of presence in the United States for purposes of the substantial presence test. See IRS Publication 519 and IRS Tax Topic 851 for more information on the Substantial Presence Test.
Form 8843 must be filed for each family member who is in the US on an F–2 or J–2 visa.
There is no monetary penalty for failure to file form 8843. However, in order to be compliant with federal regulations, you must file.
The deadline for Federal and State tax form/return is April 15. If you do not need to file any other tax form/return besides form 8843, the deadline is June 15.
